When should a Saudi employer choose a fixed-term employment contract, and what must it show?
A practical checklist for small and medium businesses: the mandatory clauses, how to word the term and renewal, what happens when work continues after the term ends, and authentication on the Qiwa platform.
A fixed-term employment contract is one in which the employer and the employee agree on a clear start date and a clear end date, so the contract ends when its term expires. This looks simple on paper, but most disputes over this type of contract that reach the labor authorities are not about pay. They are about one question: did the contract really end on its date, did it renew, or did it turn into an indefinite contract without the business noticing?
This guide is the fixed-term counterpart to the indefinite-term employment contract guide we published on 18 October. In it you will find when a fixed-term contract is the right choice for your business, the clauses it must carry step by step, how to word the term and renewal, what happens if the employee keeps working after the term ends, how it differs from the indefinite-term contract, and then authentication on the Qiwa platform and the mistakes that recur in HR departments.
Sighaty's fixed-term employment contract template E-01 is certified by a licensed Saudi lawyer and kept current with the Labor Law amendments, and it is produced in both languages within minutes through the smart-fill questions. If the employee is Saudi and you want an open-ended relationship, the companion template is the indefinite-term employment contract E-02.
Get the Fixed-Term Employment Contract templateE-01When is a fixed-term contract the right choice?
The first case leaves no choice: under the Labor Law, a non-Saudi employee's contract must be written and fixed-term. If the contract does not state its term, the term is deemed to be one year from the employee's actual commencement, and if work continues after that, the contract is deemed renewed for a similar period. The Implementing Regulation provides that a non-Saudi employee's contract stays fixed-term however long its term or renewals run, and does not turn into an indefinite contract even if the parties agree to that.
With a Saudi employee the choice is yours, and a fixed-term contract suits you where you know in advance that the need for the role is tied to a time frame or a project:
- A project or a client contract with a known end date, and you want the role to end with it.
- A new role whose value to the business you are testing before making it permanent.
- Covering a work season, a demand peak, or another employee's long absence.
- A specific piece of work that ends when it is done, since the Law provides that a contract made to perform a specific task ends when the agreed work is completed.
If the role is ongoing by nature and the employee is Saudi, the indefinite-term contract E-02 may describe the relationship more honestly, because repeated renewal may turn the contract into an indefinite one in any case, as we explain below.
The checklist: the clauses a fixed-term contract must carry
The Law requires the employment contract to be written in two copies, one kept by each party, and to be authenticated under the applicable rules. The ministry sets a unified model for each type of employment contract containing, at its core, the details below, and the parties may add other clauses that do not conflict with the Law and its regulation. Check your contract in this order:
- The employer's name and location, and the employee's name, nationality, the details needed to prove identity, and residential address.
- The type and place of work, with a job title that matches what will be recorded on the Qiwa platform.
- The agreed wage including benefits and allowances, written clearly enough to allow only one reading.
- The commencement date, and the contract term with an express start date and end date, since this is the clause that makes the contract fixed-term in the first place.
- The renewal clause: whether the contract renews, for what period, and how either party notifies the other that it does not wish to renew.
- The probation period if you want one, stated expressly and with a defined length, never exceeding 180 days in total in any case (Article 53), with the details in the probation guide.
- Each party's basic rights and obligations, then any additional clauses the business needs such as confidentiality or remote work, provided they do not breach the Law.
- Signature of two copies, then creating and authenticating the contract on the Qiwa platform with the same details.
Remember that the contract exists even if it is not written, and in that case the employee alone may prove the contract and their rights by any means of proof. In other words, the lack of a written contract does not protect the business, it shifts the burden of proof against it.
How to word the term and the renewal
A good term is written as two specific dates, not as a general phrase such as one year, renewable. Tie the start of the term to the actual commencement date rather than the signing date, because the gap between them recurs in practice and confuses the calculation of the end date.
The term of this contract is (___), starting from the employee's actual commencement date of (___) and ending on (___). The contract ends when this term expires unless the parties agree in writing to renew it under the renewal clause.
A short illustrative wording only. The full certified text of the term and renewal clauses is in the fixed-term employment contract template E-01.
Renewal has two routes: the contract includes a condition that it renews for a similar or a specified period, so it renews for the agreed period, or it has no such condition and the parties agree to renew when the term ends. In every case where the contract renews for a specified period, the new period counts as an extension of the original term when calculating the employee's service-based rights such as the end-of-service award, so renewal does not reset the clock.
This contract renews for (___) unless either party notifies the other in writing that it does not wish to renew at least (___) days before the term ends, and each renewal counts as an extension of the original term when calculating the employee's service-based rights.
The notice period here is left to the parties' agreement. Before relying on automatic renewal with a Saudi employee, read the next section; the full certified wording is in template E-01.
What happens if work continues after the term ends?
This is the section on which most disputes are built. A fixed-term contract ends when its term expires, but the Law attaches different consequences if both parties keep performing it afterwards, and the outcome depends on the employee's nationality and on whether there is a renewal condition:
- A Saudi employee and a contract with no renewal condition: if both parties keep performing the contract after its term ends, the contract is deemed renewed for an indefinite period, meaning it becomes an indefinite-term contract.
- A Saudi employee and a contract with a renewal condition: the contract renews for the agreed period, and if renewal happens three consecutive times, or the original term plus the renewals reaches four years, whichever is less, and both parties keep performing it, it turns into an indefinite-term contract.
- A non-Saudi employee: if work continues after the term ends, the contract is deemed renewed for a similar period, and it stays fixed-term however often it renews and does not turn into an indefinite-term contract.
The practical result is that the contract's end date is a management decision that must be taken before it arrives, not after. Either renew in writing and authenticate the renewal, or notify the employee of non-renewal by the agreed date, or decide consciously that the relationship has become open-ended and move the Saudi employee onto an indefinite-term contract E-02, rather than have that happen by force of law without your knowledge.
How the fixed-term contract differs from the indefinite-term contract
The difference is not just in the name. It lies in how the relationship ends and in what the harmed party is owed if it ends without a legitimate reason. These are the main differences in brief, and the full detail on the indefinite-term contract is in its published guide:
- How it ends: a fixed-term contract ends when its term expires unless it is expressly renewed, while an indefinite contract ends at the will of either party for a legitimate reason with written notice as the Law sets.
- Compensation for termination without a legitimate reason: unless the contract sets compensation, the harmed party under a fixed-term contract is owed the wage for the remaining term, and under an indefinite contract fifteen days' wage for each year of service, and in both cases the compensation is not less than two months' wage.
- Who it can be used with: a fixed-term contract works for Saudi and non-Saudi employees alike, while a non-Saudi employee's contract can only be fixed-term.
- Managing dates: a fixed-term contract needs tracking of its end date and the number of renewals, while an indefinite contract does not, but it needs a documented legitimate reason when it is ended.
This is why a fixed-term contract can be costly if the business ends it early without a legitimate reason and a long period remains. So do not write a term longer than your real need in the belief that it gives you security.
Qiwa authentication and the HR mistakes with term and renewal
According to the contract authentication procedural guide issued by the Ministry of Human Resources and Social Development, the business creates the employment contract through its account on the Qiwa platform, then the employee accepts, rejects or requests changes to the contract through their Qiwa Individuals account, and once both parties agree the contract is deemed authenticated by the ministry. The service steps in detail are in the Qiwa contract authentication guide. On term and renewal, these are the most frequent mistakes:
- Letting a Saudi employee keep working after the term ends without a written renewal, so the contract is deemed renewed for an indefinite period.
- Relying on automatic renewal for years without counting the renewals and the total period, then treating the contract as if it were still fixed-term.
- A mismatch in the end date, the wage or the job title between the paper copy and the contract authenticated on Qiwa.
- Assuming a non-Saudi employee's contract turns indefinite with long service, when it does not in any case.
- Inserting a new probation period in the renewal contract for the same work, although the Law does not allow an employee to be placed on probation more than once with the same employer except in specific exceptional cases (Article 54).
- Changing the wage or job title at renewal by verbal agreement without updating the authenticated contract.
A licensed Saudi lawyer keeps your contracts current: the lesson of the administrative support Saudization decision
On 4 October 2026 the Ministry of Human Resources and Social Development announced that the decision to Saudize administrative support professions had entered into force at 100 percent in the private sector, targeting the Saudization of 69 administrative support professions. For a small business this means employment contracts in these professions need review: contracts for new Saudi hires must be written with the correct title, term and wage from day one, and existing contracts need a considered decision at the end of their term instead of being left to renew automatically.
This is exactly what a lawyer-maintained template protects you from: laws and decisions change, and the contract you downloaded a year ago may not reflect the current text. Sighaty's templates are certified by Abdulaziz Sukkar, a licensed Saudi lawyer, and updated with every legal amendment. For details on contracts in the covered professions, see our published guides on the administrative support Saudization grace period. This guide is general information, not legal advice on any specific case, and the Arabic text prevails in case of difference. Frequently asked questions
Can a business sign an indefinite-term contract with a non-Saudi employee?
No. A non-Saudi employee's contract must be written and fixed-term, and if it does not state its term, the term is deemed one year from actual commencement. It stays fixed-term however long it runs or however often it renews, even if the parties agree otherwise, so the right template is E-01.
When does a fixed-term contract with a Saudi employee become indefinite?
In two cases: if both parties keep performing it after its term ends without a renewal condition, or if it has a renewal condition and renewal happens three consecutive times or the total period reaches four years, whichever is less, and both parties keep performing it.
Do renewal periods count toward the end-of-service award?
Yes. In every case where the contract renews for a specified period, the renewal period counts as an extension of the original term when calculating the employee's rights that depend on length of service, including the end-of-service award.
What is owed if the other party ends a fixed-term contract early without a legitimate reason?
Unless the contract sets compensation, the harmed party is owed the wage for the remaining term, and the compensation may not be less than two months' wage. Because every case has its own facts, consult a lawyer before deciding to terminate.
Is a signed paper contract enough without authenticating it on Qiwa?
It is not enough. The Law requires the employment contract to be authenticated under the applicable rules, and authentication is done on the Qiwa platform with both parties' approval. Make sure the authenticated contract matches the signed copy on term, wage and title.
